The Appellate Division, First Department, of the New York Supreme Court, granted Tuttle Yick’s client a complete victory and reversed the trial court on appeal. The First Department held that the trial court misapplied Section 404(b) of the CPLR when it summarily determined a petition to determine trust authority without providing the petitioners a meaningful opportunity to reply to papers raised for the first time by opposition. The First Department remanded the matter back to the trial court. Tuttle Yick’s appellate team included partners Greg Tuttle and Alex Banzhaf, and associate Alexa DePierro.
