Tuttle Yick Client Prevails in First Department Appeal

The Appellate Division, First Department, of the New York Supreme Court, granted Tuttle Yick’s client a complete victory and reversed the trial court on appeal. The First Department held that the trial court misapplied Section 404(b) of the CPLR when it summarily determined a petition to determine trust authority without providing the petitioners a meaningful opportunity to reply to papers raised for the first time by opposition.
