Tuttle Yick Client Obtains Dismissal of Federal Trademark Claims in the District of Connecticut

In a February 24, 2025 decision, Tuttle Yick clients Zaiger LLC and Jeffrey Zaiger obtained a complete dismissal of the lawsuit filed by Willliam Bucher and his law firm Bucher PLLC in 2023. After staying discovery shortly after the action was filed, Judge Alvin Thompson has now granted the defendants’ motion to dismiss, throwing out plaintiffs’ claims under the Lanham Act, with prejudice, on the grounds that Bucher, among other things had (1) not alleged damages; (2) could not show that certain communications qualified as commercial advertising. The District Court then declined to exercise jurisdiction over the remaining state law claims.
