In a dispute over an insurance broker’s failure to procure insurance, the broker filed a motion for summary judgment arguing that even if insurance had been obtained, it would not have covered the property owner’s (Tuttle Yick’s client) claimed damages from a leaking pipe. Alex Banzhaf of Tuttle Yick successfully argued that the policy’s exclusions did not apply and the policy would have covered the loss. Magistrate Judge Wicks agreed in a report and recommendation that issues of fact and disagreements between the parties’ respective experts precluded summary judgment.
