Tuttle Yick Client Caribbean CAGE Prevails in Motion to Dismiss

Tuttle Yick client Caribbean CAGE — a Caribbean and Latin American video lottery company — and its affiliate prevailed in a contract dispute filed in the Supreme Court of New York’s Commercial Division. In a September 26, 2023 order, Justice Crane granted CAGE’s motion to dismiss the complaint at the pleading stage and held that the plaintiff could not establish personal jurisdiction in New York either under the relevant agreement’s forum selection clause, or under traditional principles of specific or general jurisdiction.
