Austin Fincher
Austin L. Fincher is an Associate within Tuttle Yick LLP’s License & Access Agreements / RPAPL § 881 practice group.
Austin represents a diverse group of developers, owners, construction companies, trade contractors, and design professionals in a broad range of real estate development and construction matters. Acting as counsel for the full cycle of a real estate development project, Austin provides a holistic approach for his clients.
Working closely with Eli Raider, Austin represents parties in the negotiation of license and access agreements and in RPAPL § 881 actions. Austin is known for finding creative solutions to issues that arise during new real estate development, and engineering innovative resolutions to solve complicated disputes.
Austin is also an effective commercial litigator, having litigated in the state and federal courts of New York, including before the United States Court of Appeals for the Second Circuit. Some of Austin’s recent accomplishments include:
- Obtaining a $2M judgment in a breach of contract dispute between a general contractor and a subcontractor
- Winning a pre-answer motion to dismiss against a federally chartered bank in the Southern District of New York
- Negotiating license and access agreements that permitted underpinning, tiebacks, and lot line window closures with multiple neighbors
