Tuttle Yick’s employment attorney Alex Banzhaf recently obtained a favorable settlement in a lawsuit under the New York City Human Right Law alleging that a construction foreman sexually harassed three separate workers. The District Attorneys in Manhattan and Brooklyn also commenced criminal actions against the construction foreman based on the allegations.
Tuttle Yick investigated the allegations of impropriety and uncovered substantial evidence that one of the workers was in a consensual relationship with the foreman that was limited to “off the job” time. That consensual relationship involved substantial evidence of the worker asking the foreman for money and other gifts. When the consensual relationship ended, the worker retaliated by recruiting two other workers to bring meritless allegations of workplace sexual harassment.
Tuttle Yick worked with the foreman’s public defender and provided the evidence necessary to have all three criminal cases dismissed for lack of evidence. And Tuttle Yick provided the evidence to the workers’ attorney and negotiated a settlement at a fraction of the workers’ demand.
